
(FreePressBeacon.com) – America is heading down an alarming path as Daniel Toma from Kentucky ended up homeless after a judge ruled in favor of friends who turned into unwelcome guests in his garage.
These friends, Amy Davis and her boyfriend Tyler Sencuk, had been staying at Toma’s after their car broke down.
This arrangement led them to treat his garage like their own place, complete with a mattress, changed locks and even a cable TV setup, all without paying.
“I didn’t want to throw them out on the street, I was just trying to be kind,” Toma explained.
The situation escalated when Toma posted a 30-day eviction notice around Labor Day after being unable to convince them to leave and with no formal lease in place.
In response, an altercation broke out between Sencuk and one of Toma’s roommates, and Sencuk quickly sought legal action against Toma.
“We tried to tell them to leave. He started saying (they) had squatters rights,” Toma said about the standoff.
Surprisingly, a judge issued an emergency protective order against Toma. The judge thought him to be a roommate rather than the homeowner and banned him from coming close to the couple or his own house.
“I just want this nightmare to end. I’ve been homeless the last few days,” Toma lamented. “I feel like I have no power. I feel like I have no rights.”
Sencuk claims there was an understanding that he could stay in exchange for doing maintenance around the house, a claim Toma denies.
“The bills are in my name. I need to take care of things, and I want to sleep in my own bed too,” Toma stated.
Under Kentucky law, squatters can remain on a property unless explicitly told they are not welcome.
The homeowner must file a formal eviction to remove them, which Toma had tried without success.
While Sencuk has since moved out, Davis’ status is unknown, and Toma continues to fight the protective order in court.
