This landmark decision empowers immigration officials to crack down on those attempting to abuse the system and infiltrate the borders through deception.
The case, Bouarfa v. Mayorkas, centered on a Palestinian man whose visa was revoked by the Department of Homeland Security (DHS) due to a previous fraudulent marriage.
The Supreme Court’s ruling, delivered in a 9-0 decision, affirms that federal courts have no authority to review the government’s decision to revoke an immigration visa.
Justice Ketanji Brown Jackson’s writing for the court emphasized the broad discretion of DHS in managing visa affairs.
The case began when Amina Bouarfa, a U.S. citizen, married Ala’a Hamayel, a noncitizen. Bouarfa filed an immigration petition for her husband, which was initially approved.
However, United States Citizenship and Immigration Services (USCIS) later revoked the approval after discovering evidence of a fraudulent marriage in Hamayel’s past.
Bouarfa challenged the revocation, but her efforts were repeatedly thwarted. The Board of Immigration Appeals ruled against her, and when she sued in federal court, her case was dismissed.
The U.S. Court of Appeals for the 11th Circuit affirmed the dismissal, setting the stage for the Supreme Court’s final verdict.
Moreover, Justice Jackson’s opinion reinforced the government’s authority in these matters, noting that the DHS secretary has the power to revoke visa approval for “good and sufficient cause.”
